Se ordenó inaplicar en el presente caso el numeral 1º del Art. 1º del Decreto 1382 de 2000 por inconstitucional.
Con base en lo anterior, se resolverá el conflicto de competencia suscitado entre el Juzgado 33 Penal del Circuito de Bogotá y el Tribunal Administrativo de Cundinamarca, en el sentido de adscribir al Juzgado 33 Penal del Circuito de Bogotá el conocimiento de la tutela instaurada por el ciudadano de la referencia.

- PRIMERO. En el presente caso INAPLICAR por inconstitucional el numeral 1o del articulo 1o del decreto 1382 de 2000. En consecuencia DECIDIR la colision de competencias suscitada entre el Juzgado 33 Penal del Circuito de Bogota y el Tribunal Administrativo de Cundinamarca, en el sentido de adscribir al Juzgado 33 Penal del Circuito de Bogota el conocimiento de la tutela instaurada por el senor BALDUINO JOSE ALMARIO HOYOS.
- Por Secretaria remitase el expediente al referido Juzgado.
